Please carefully read the terms and conditions set out below. They set out the rules governing our short film competition and how we may use your entry to the competition. In these terms and conditions “us” or “we” means Seventh-day Adventist Church – Australia Union Conference (ABN 24 112 101 783), and “you” means the person submitting an entry. By selecting and activating the “I Agree” button you agree to comply with these terms and conditions (as amended from time to time, the Terms).

  1. Background to the Competition
    • Our short film competition (the Competition) is intended to give young Australian aspiring filmmakers with an opportunity to win one of the prizes set out below, while providing us and our licensees and assigns with a range of content to use in connection with our media activities across our media group and platforms. That is why you grant us certain rights to use your entry (your Film) under these Terms.
    • Your Film can be of any genre, but must be faith-based, must address how or why being a child of God makes your life better, and must refer to the Seventh-day Adventist Church, whether through dialogue, caption, images or otherwise (the Theme).
    • We will only accept Films on these Terms.
  2. Eligibility Criteria
    • For reasons of copyright, and to make sure these Terms have the intended effect, the Competition is open only to Australian residents aged 18 to 30 years as at the date of entry.
    • All employees of the Seventh-day Adventist Church whose role involves any media relations (and any of their affiliates) are not eligible to enter the Competition.
    • You can only enter the Competition as an individual, not as a group.
    • All of the conditions set out in this clause 2 are the “Eligibility Criteria”.
  3. Acceptance Criteria
    • You can enter multiple Films in the Competition, provided that each Film is substantially different from any other Film that submit to the Competition.
    • Your Film (along with all accompanying materials required under these Terms) must be received by 12pm (midday) Australian Eastern Standard Time (AEST), on 15 November 2017. Any entries received after that time will not be eligible to enter the Competition.
    • Each Film must:
      • have been made only for the Competition, and not been previously made, or existed, in earlier versions;
      • only be entered in the Competition once;
      • incorporate, and fulfil the requirements of, the Theme;
      • be no longer than 5 minutes in total duration, excluding any titles or credits, and if titles or credits are used, the Film must be no longer than 5 minutes and 10 seconds, including titles and credits;
      • have English subtitles if the Film contains any non-English audio (but there is no requirement that the Film include any dialogue);
      • where the Film contains any third party material such as footage, photographs, music, films, sound recordings, broadcasts, or brands owned by a third party, third party quotes or samples from other works, each such use must be covered by a written clearance in a properly executed form approved by us. (The forms contained in our Competition Resources Pack at the bottom of the entry page here are approved);
      • be delivered to us via The Entrant’s Vimeo and/or YouTube account, and only in the following formats:
        • Vimeo standard definition (640 x 480 px (4:3 aspect ratio) or 640 x 360 px (16:9 aspect ratio) or Vimeo high definition (720 p (1280 x 720 px) or 1080 p (1920 x 1080 px))
        • Audio: AAC-LC codec, at 320 kbit/s and 48 kHz
        • Codec: Any codec compatible with Vimeo (H.264 is recommended). Note that G2M2, G2M3 and Conopus HQ are not Vimeo compatible codecs.
        • Duration: Maximum 00:05:00 (excluding titles & credits)
        • Duration of titles and credits (if used): Maximum 00:00:10 (in addition to maximum duration of film specified above)
        • Initial upload size is limited to 250MB, full broadcast quality must be available upon request.
      • be accompanied by at least three high definition still images from the Film; and
      • be accompanied by all supporting clearance documentation, in clearly legible form, signed and delivered to us via email (details here), and only in PDF format,

(together with clauses 3.1 and 3.2, the Acceptance Criteria).

  • We will determine at our sole discretion:
    • whether your Film meets the Eligibility Criteria and the Acceptance Criteria; and
    • whether your Film is included in a shortlist or is selected as a finalist or a winner, or does not so qualify,

and our determination is final and is not subject to appeal in anyway.

  • We are not obliged to enter any correspondence with you in relation to our determination. If we wish to communicate our determination to you, we will do so via the email address you provided in the entry form (Entry Form) you submitted to us when you registered your Film (your Email Address). All finalists will be notified by email to their Email Address by 5pm AEST on 1 December 2017.
  • We can, in our sole discretion, disqualify your Film from the Competition at any time without prior notice to you if we believe for any reason that your Film does not comply with the Eligibility Criteria or Acceptance Criteria or otherwise with these Terms.
  1. Winning a Place
    • We will award prizes to three entrants as follows:
      • the entrant who is awarded first-place (First-place Winner) will receive an all-expenses paid trip to a location in the Middle East to be selected by us, to participate in creating a film for Hope Channel Australia;
      • the entrant who is awarded second-place (Second-place Winner) will receive an all-expenses paid trip to a location in the South Pacific to be selected by us, to participate in filming a project in partnership with Adventist Development and Relief Agency Australia;
      • the entrant who is awarded third-place (Third-place Winner) will receive an opportunity to film a project in a location in Australia to be selected by us, to participate in creating a film for Hope Channel Australia.

(Together, the First-place Winner, Second-Place Winner and Third-place Winner are the Winners.)

  • Each prize will be conditional on the place-getter agreeing to enter a production agreement with us in return for us meeting the cost of that entrant travelling to the relevant destination and making a further film, which we will own. The standard terms of the prize-winner’s production agreement can be found here.
  • If a place-getter declines to enter that production agreement and thus refuses the prize, we can offer that prize to another entrant, at our discretion.
  • Winners will be announced at the 2017 Australian Union Conference End of Year Meetings in Melbourne, Australia on 30 November 2017, and published in the immediately subsequent edition of Adventist Record. Winners will also be notified separately by email to their Email Address. Winners must claim their prize by 1 February 2018, or the prize will be deemed forfeited.
  1. Rights
    • By entering the Competition, you grant us an exclusive, transferable, sub-licenseable, perpetual, irrevocable, worldwide, royalty-free licence to reproduce and communicate the Film to the public and to cause it to be seen and heard in public, to edit the Film to compile it with other film, to create derivative works from it such as clips or highlights from the Film, and to do any of the foregoing things with that compilation or those derivative works (our Licence).
    • However, our Licence will immediately become non-exclusive if:
      • we communicate to your Email Address our determination that your Film:
        • does not meet the Eligibility Criteria or Acceptance Criteria; or
        • is not shortlisted; or
        • is not a first, second or third place-getter; or
      • we have not communicated any of the determinations set out in clause 3.2(a) above to your Email Address within 30 days of our advertised date for the closing of entries; or
      • your Film is disqualified from the Competition.
    • If our Licence becomes non-exclusive in accordance with clause 5.2, then as between you and us, you are free to deal with your Film as you see fit, subject only to our continuing non-exclusive licence.
    • You acknowledge that we, and our assignees and licensees, can:
      • dub, subtitle, cut and edit the Film in any way we deem necessary, including, without limitation, for the purpose of television broadcast or online distribution, packaging the Film with other films, to comply with broadcasting or statutory censorship or policy practices, standards or regulations, or as otherwise may be required by law in any applicable country where the Film may be used;
      • do or omit to do anything which may infringe any and all of your moral rights including, without limitation, editing, altering or reproducing your work. You consent to these actions in any manner or context, in perpetuity throughout the world, to the full extent permitted under the Copyright Act 1968 (Cth);
      • use your name, likeness and biography in connection with the Competition; and
      • do any and all acts comprised in the Moral Rights Consents (defined below).
  1. Your Representations and Warranties
  • You represent and warrant that:
    • you have the full right and authority to accept these Terms and to enter this agreement and grant the rights granted in these Terms;
    • the Film complies with the Terms;
    • you meet the Eligibility Criteria;
    • all details you submitted in the Entry Form are true and correct;
    • you are the sole and exclusive owner of, or have validly licensed or have written permission from the sole and exclusive owner, all rights required to:
      • create the Film, including but not limited to all rights and written consents from performers and participants, to the use of their performances in the Film, and all rights from script-writers;
      • create all other elements of the Film, including but not limited to all rights in third party materials and all rights in the musical works, lyrics and sound recordings comprising the soundtrack of the Film;
      • without limiting the above, reproduce and use the results and proceeds of the services or contributions of contributors to the Film (each a Contributor) including, without limitation the right to edit, alter or reproduce the results and proceeds of the Contributor’s involvement in the Film, in any manner or context, by you or your licensees or assigns, and such consents have been obtained to the full extent permitted under the Copyright Act 1968 (Cth), and the right to use each Contributor’s name and likeness of in connection with any publicity for the Competition (Moral Rights Consents); and
      • submit the Film to the Competition;
    • all residuals or other payments to Contributors in connection with the Film have been paid, together with the cost of all licenses of all copyright and any Film footage, musical works, lyrics, sound recordings or other material in which copyright subsists, owned by any third parties and which are used or adapted in the Film;
    • no part of the Film is the subject of any current or threatened claim or litigation, and the use or exploitation of the Film will not be actionable for defamation, violate any right of privacy or publicity, or violate the rights (including copyright or moral rights) of any third party; and
    • unless and until our Licence becomes non-exclusive:
      • you have not, and will not, assign, license or otherwise grant, in whole or in part, the rights (including the intellectual property rights) in the Film to any person or entity other than us; and
      • the Film has not been, and will not be, available to be viewed by the public by any means or format, including by the internet.
    • You indemnify us from and against any and all claims or demands made against us, or our assignees or licensees, in relation to the warranties and representations you make in these Terms.
  1. General
    • We can assign this agreement, in whole or in part, to any person, firm or corporation, and this agreement will be binding upon and inure to the benefit of our successors, licensees and assigns. You cannot not assign this agreement.
    • You will do all such acts and sign, or cause to be signed, such instruments as we may reasonably request for the purposes of this agreement.
    • Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
    • The Terms contain the entire agreement between you and us relating to the Competition and supersedes any prior agreement. The validity, construction, breach and operation of these Terms are governed by the laws of, and must be adjudicated in, the State of New South Wales.
    • If any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
    • In the interpretation of these Terms, unless the context otherwise requires: words and phrases defined in the Copyright Act 1968 (Cth); and words importing the singular include the plural and vice versa. These Terms will prevail to the extent of any inconsistency between these Terms and any other material or language used in any other material associated with the Competition, such as our website for the Competition.
    • Neither these Terms, nor your entry into the Competition, creates any agency, partnership or employee/employer relationship between you and us.
    • Any notices required or able to be given by us under this Agreement may be given by email to any email address you provide to us. Any notices required or able to be given by you may be sent here.
